End User License Agreement

This agreement is between you and Green Delta Systems (“we”) for the software Yellow's Out (the “Software”). Installing or using the Software means you accept it. The same text is shown by the installer.

1. License

On purchase we grant you a personal, non-exclusive, non-transferable license to install and use the Software on one computer at a time (you may move the activation between computers you own or control), for your own race-directing, broadcasting and related purposes, including commercial broadcasts. The Software is licensed, not sold.

2. License keys and validation

The Software requires a license key and periodically confirms it with our licensing provider, Polar, over the internet. Between checks it works offline for up to 14 days. You must not share your key, bypass or interfere with the license check, or use a key you did not purchase. We may revoke keys that are shared, resold or obtained fraudulently, and keys are normally revoked when an order is refunded or charged back.

3. Restrictions

You may not copy the Software except for backup, modify it, reverse engineer or decompile it beyond what applicable law expressly permits, remove notices from it, or redistribute, rent, lease or sublicense it.

4. iRacing

The Software works with the iRacing simulator by reading its published telemetry interface and sending it commands you choose to send, including chat and admin commands in sessions you have the right to administer. You are responsible for what you do in those sessions and for complying with iRacing's terms and sporting code. iRacing.com Motorsport Simulations, LLC is not affiliated with us and does not endorse the Software.

5. Updates

We may release updates. Updates to the same major version are included in your license. We are not obliged to provide updates or to keep the Software compatible with future versions of iRacing or Windows, though we intend to.

6. No warranty; limitation of liability

The Software is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Race outcomes, broadcast results and decisions made using the Software are yours. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or lost profits, arising from the Software, and our total liability is limited to the price you paid.

7. Term

This license lasts until terminated. It ends automatically if you breach it; on termination you must stop using the Software and delete your copies. Sections 3, 6 and 8 survive termination.

8. General

This agreement is governed by the laws of the State of Tennessee, USA. If any part is unenforceable, the rest still applies. It is the entire agreement about the Software and replaces any earlier understanding. Questions: support@greendeltasystems.com.
