This agreement is between you and Green Delta Systems (“we”) for the software Yellow's Out (the “Software”). Installing or using the Software means you accept it. The same text is shown by the installer.

1. License

On purchase we grant you a personal, non-exclusive, non-transferable license to install and use the Software on one computer at a time (you may move the activation between computers you own or control), for your own race-directing, broadcasting and related purposes, including commercial broadcasts. The Software is licensed, not sold.

2. License keys and validation

The Software requires a license key and periodically confirms it with our licensing provider, Polar, over the internet. Between checks it works offline for up to 14 days. You must not share your key, bypass or interfere with the license check, or use a key you did not purchase. We may revoke keys that are shared, resold or obtained fraudulently, and keys are normally revoked when an order is refunded or charged back.

3. Restrictions

You may not copy the Software except for backup, modify it, reverse engineer or decompile it beyond what applicable law expressly permits, remove notices from it, or redistribute, rent, lease or sublicense it.

4. iRacing

The Software works with the iRacing simulator by reading its published telemetry interface and sending it commands you choose to send, including chat and admin commands in sessions you have the right to administer. You are responsible for what you do in those sessions and for complying with iRacing's terms and sporting code. iRacing.com Motorsport Simulations, LLC is not affiliated with us and does not endorse the Software.

5. Updates

We may release updates. Updates to the same major version are included in your license. We are not obliged to provide updates or to keep the Software compatible with future versions of iRacing or Windows, though we intend to.

6. No warranty; limitation of liability

The Software is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Race outcomes, broadcast results and decisions made using the Software are yours. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or lost profits, arising from the Software, and our total liability is limited to the price you paid.

7. Term

This license lasts until terminated. It ends automatically if you breach it; on termination you must stop using the Software and delete your copies. Sections 3, 6 and 8 survive termination.

8. General

This agreement is governed by the laws of the State of Tennessee, USA. If any part is unenforceable, the rest still applies. It is the entire agreement about the Software and replaces any earlier understanding. Questions: support@greendeltasystems.com.

Pitwall

This End User License Agreement (“Agreement”) is between you and Green Delta Systems (“Green Delta Systems”, “we”, “us”), an independent software studio in Nashville, TN. It covers the Pitwall software, its updates, and its documentation (“Pitwall”).

By installing or using Pitwall, you agree to this Agreement. If you don't agree, don't install or use Pitwall. If you bought Pitwall and don't agree, you can ask for a refund under section 9.

1. License

On purchase we grant you a personal, non-exclusive, non-transferable license to install and use Pitwall on one computer at a time (you may move the activation between computers you own or control), for your own sim racing, practice, analysis, and coaching purposes, including paid coaching. Pitwall is licensed, not sold; we keep all rights not expressly granted to you.

2. License keys and validation

Pitwall requires a license key and periodically confirms it with our licensing provider, Polar, over the internet. Between checks it works offline for up to 14 days. You must not share your key, bypass or interfere with the license check, or use a key you did not purchase. We may revoke keys that are shared, resold, or obtained fraudulently, and keys are normally revoked when an order is refunded or charged back.

3. What you may not do

You may not:

a. copy Pitwall, except to install it as allowed above and to make backups;

b. sell, rent, lease, lend, sublicense, share, or otherwise distribute Pitwall or your license key;

c. reverse engineer, decompile, or disassemble Pitwall, except to the extent applicable law expressly allows it despite this restriction;

d. remove or change any copyright, trademark, or license notices;

e. use Pitwall in a way that breaks the law or iRacing's terms of use.

4. Your data

Telemetry, sessions, laps, notes, and settings that Pitwall records are stored on your computer and belong to you. We don't receive them unless you send them to us, for example in a support request. Our Privacy Policy, included with Pitwall, explains what Pitwall stores and how we handle information you send us.

5. Third-party components

Pitwall includes third-party software components, each provided under its own license. Those licenses are listed in the THIRD-PARTY-NOTICES file included with Pitwall. Where a third-party license applies to a component, it governs your use of that component.

6. iRacing

Pitwall works with the iRacing simulator by reading the telemetry iRacing makes available while it runs. You need your own iRacing account and subscription, which you get separately from iRacing.com Motorsport Simulations, LLC under its own terms.

Pitwall is an independent product. It is not affiliated with, endorsed by, or sponsored by iRacing.com Motorsport Simulations, LLC. “iRacing” is a trademark of iRacing.com Motorsport Simulations, LLC and is used only to describe what Pitwall works with. Changes iRacing makes to its software may affect how Pitwall works, and we can't guarantee compatibility with every iRacing version.

7. Updates and support

We may release updates. Updates to the same major version are included in your license; we may charge separately for future major versions. We are not obliged to provide updates or to keep Pitwall compatible with future versions of iRacing or Windows, though we intend to. Support is provided by email at support@greendeltasystems.com.

8. Accuracy

Pitwall shows telemetry, lap times, track maps, and analysis derived from data iRacing provides. Some values (for example track maps, sector times, and estimated lap times) are calculated or reconstructed and may not match iRacing's official figures. Pitwall is a training and analysis tool for simulated racing only. Don't rely on it for anything where an error could cause injury or loss, and never use it with real vehicles.

9. Payment and refunds

Purchases are processed by Polar Software Inc. (“Polar”), our merchant of record, which charges your payment method, issues your receipt, and handles applicable sales tax or VAT under its own terms. If Pitwall doesn't work for you, you can get a full refund within 14 days of purchase by emailing support@greendeltasystems.com from the address you bought with. Our full Refund Policy is at https://greendeltasystems.com/legal/refunds. Your license key is revoked when the refund is issued. Nothing in this Agreement limits refund rights you have under the law where you live.

10. Disclaimer of warranties

TO THE EXTENT PERMITTED BY LAW, PITWALL IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT PITWALL WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH ANY PARTICULAR VERSION OF IRACING OR WINDOWS, OR THAT IT WILL NEVER LOSE DATA. KEEP BACKUPS OF DATA YOU CARE ABOUT.

Some jurisdictions don't allow certain warranty exclusions, so some of the above may not apply to you.

11. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, GREEN DELTA SYSTEMS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS, OR LOST RACE RESULTS, ARISING FROM OR RELATED TO PITWALL, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO PITWALL IS LIMITED TO THE PRICE YOU PAID FOR PITWALL.

Some jurisdictions don't allow these limitations, so some of them may not apply to you. Nothing in this Agreement limits liability that can't be limited by law.

12. Termination

This Agreement ends automatically if you break it. You can end it at any time by uninstalling Pitwall. When it ends, you must stop using Pitwall and delete your copies. Your recorded data stays yours. Sections 3, 4, 8, 10, 11, and 13 continue to apply after it ends.

13. General

This Agreement is governed by the laws of the State of Tennessee, USA. If you are a consumer, you keep any protections the law where you live gives you. This Agreement, together with the Privacy Policy, is the entire agreement between you and us about Pitwall and replaces any earlier understanding. If any part is found unenforceable, the rest stays in effect. If we don't enforce a part, we haven't waived it. You may not transfer this Agreement; we may transfer it as part of a sale or reorganization of our business. If we change this Agreement, Pitwall will ask you to accept the new version before you keep using it.
